To get a divorce in Georgia, at least one spouse must be a resident for at least six months. If neither spouse lives in Georgia while filing a divorce, the couple must have last lived together in Georgia. To file for divorce, you must file a petition at the Superior Court in the county where either party currently resides. The individuals must be “legally separated”, which entails not practicing marital relations and living in a state of disengagement. If you need immediate court assistance, you can request a temporary court order that can address alimony, child custody, visitation, child support, debts, or possession of property that will hold valid until the time of the final trial. In Georgia, if a divorced couple has children, even after a finalized divorce they are responsible to support any children typically until the age of eighteen. Also, if the individual requesting alimony has caused desertion or adultery during the marriage, no alimony will be approved. However, each spouse is accredited to a justifiable share of the marital property.
Once you decide to divorce, you can choose to file an uncontested or contested divorce. An uncontested divorce is when both individuals have mutually agreed to divorce and to respectfully settle on how to divide property, take care of child custody, child visitation, and child support. However, a contested divorce is when you cannot reach an agreement on the above issues.
